ILMA is seeking clarification from OSHA about label regs.
The Independent Lubricant Manufacturers Association (ILMA) is concerned that the June 1st 2015 labelling and data sheets compliance deadline is causing the lubes industry severe problems, according to Lube Report.
The new standards mean end users can be penalised if they fail to meet the Occupational Safety and Health Administration’s (OSHA) compliance.
Lubes companies need to receive the necessary data from raw materials suppliers. Lube Report states that the OSHA has accommodated this challenge by asking companies to perform due diligence and make good-faith efforts to acquire the necessary data by the deadline. The Administration has also suggested alternative ways of complying, although many of these have significant costs attached.
Although the new regulations apply to a wide range of companies that handle chemicals, Lube Report calculates that more than 300 US lubes companies are affected. It quotes ILMA’s legal counsel Jeffery Leiter, of Leiter & Cramer PLLC, as saying: “The one-size-fits-all compliance deadline for everyone in the supply chain is creating an enormous number of complications and problems”.
ILMA and a number of other trade groups have apparently asked OSHA to provide amendments to the final enforcement procedure.
